Changes to the FTC Rules on Non-Compete Agreements
On May 7, 2024, the FTC issued a rule banning nearly all non-compete agreements for workers, considering them "unfair methods of competition."  Depending on how it is interpreted by courts, the rule may even reach non-solicitation provisions. This rule, effective September 4, 2024, includes exceptions for senior executives and sale-of-business agreements, and requires employers to inform employees that existing non-competes are no longer enforceable. Employers need to prepare by reviewing and possibly revising their employment agreements to comply with the new regulations.
